Terms and conditions


1. Summary

In short, you are engaging Rex’s Yarra Valley House as an independent business to provide you with accommodation. In this agreement you won’t find complicated legal terms or unreadable text. We have no desire to trick you and want what is best to ensure that both parties are protected now and in the future.

You authorise Rex’s Yarra Valley House to fulfill any work established in communication and to finalise your booking. You have the power and ability to enter into this agreement on behalf of your company or self. The authorisation in this agreement forms the legal bond between Rex’s Yarra Valley House and yourself or business.

1.1 House Rules

We take pride in providing our guests a home that is cleaned thoroughly and maintained to a high standard.

To help us maintain that standard, we have a few straight forward house rules.

  • Maximum Number of Guests – The number of guests on the rented premises must not exceed the number of beds provided or the number agreed to with the agent at the time of booking. No caravans or tents are to be erected on the property.
  • Noise – We ask that you respectfully consider the neighbours and comply with any statutory laws and regulations applicable to the premises.
  • Weddings, Parties, Events……. anything – Rex’s Yarra Valley House is used purely for holiday accommodation only. A charge will be incurred should any type of party or function be held on the property. All bond monies will automatically be forfeited and you will be required to vacate the property immediately if any sort of function is held on the rented property.
  • Inspections – The tenant/s will permit the agent and persons authorised by the agent to enter the premises during the letting term for the purpose of necessary repair, investigation of complaints or inspection of the premises if the agent is inclined to suspect or has been informed that extra persons are occupying the premises.
  • Cleaning – Please leave the premises in a reasonably tidy and clean condition. The tenant shall discard all food items from the refrigerator and lock premises (including windows) on vacation. Please ensure all lights, air conditioners, heaters etc are switched off. Any excess cleaning or removal of excess rubbish will be deducted from the bond. Guests who do not comply with this will be charged an excess cleaning fee.
  • Furniture – The guest/s will not move indoor furniture from original state. If furniture is moved you will be charged an additional $200.00 to have the furniture moved back to its original state. Any damage caused by the furniture being moved will be deducted from your bond.
  • BBQ Facilities – A BBQ is provided for your convenience. The BBQ must be cleaned before exiting the property and all outdoor furniture returned to its original configuration. A cleaning fee will apply to the BBQ if left in an unreasonable state.
  • Smoking – Rex’s Yarra Valley House is non-smoking. Please do not leave discarded cigarette butts in the outdoor areas, any butts that need removing from pathways, lawns, garden beds etc will incur a cleaning fee.
  • Arrivals & Departures – The property will be available for the check in time on the day of arrival. You must vacate the property by 11am on the day of departure as we often have new guests checking in on the same day. We endeavour to accommodate special requests although we recommend booking an extra day for early check in or late check-out. We do not have the facilities to store personal belongings before arrival or after departure. Please ensure you place key back in the key safe on departure.
  • Keys – Keys will be prearranged for arrival. Loss of keys will incur a $200.00 charge separate to the bond.
  • Damage – As a guest, you are responsible for all damages, breakages and losses incurred during the occupancy. All damages, breakages and losses must be replaced, repaid for or made good to the satisfaction of the agent/owner. This includes replacing/re-cutting lost keys. The tenant/s will take all reasonable care of the premises and promptly report to the agent any malfunctions, damage and losses.
  • Linen – Rex’s Yarra Valley House provides all linens, towels and bathroom amenities.
  • Pets – No pets are permitted. All bond monies will automatically be forfeited, and you will be required to vacate the property immediately if pets are found on the rented property.
  •  Wildlife – It is very likely wildlife may enter the property, please use caution and avoid any wildlife where possible. You must assist injured wildlife by contacting the Healesville Sanctuary or Wildlife Victoria.
  • Personal Property – No responsibility will be taken by the agent or the owner for any guest possessions left at the property. If any items are left and need to be returned, a self-addressed post bag is to be sent to our office for items to be retrieved.
  • Indemnity – The Guest/s: uses and occupies the premises at his/her own risk: and indemnifies the owner/agent against any liability which may attach to the owner/agent as a result of injury or loss of being personal or proprietary suffered by any person where any damage or loss has been contributed to or caused by any act or occasion of the guest or his/her agent.
  • Disclaimer – Rex’s Yarra Valley House does not accept liability in contract or tort for any injury, damage, loss, delay, additional expense or inconvenience caused directly or indirectly by force majeure or other events which are beyond our control or which are not preventable by reasonable diligence on our part including, but not limited to war, civil disturbance, fire, floods, extreme weather, acts of God, acts of Government or any other authorities, accidents, theft to or failure of machinery or equipment or industrial action. For the avoidance of doubt, the Cancellation Policy applies to cancellations by reason directly or indirectly related to events which are beyond our control including warnings issued by any authority.
  • Privacy Act – Your privacy is very important to us and is only disclosed when absolutely necessary. Personal information Guest/s provides or that which is collected from other sources is necessary for the Agent to verify the applicant’s identity, to process the booking and contact the Guest/s. Any personal information collected about the Guest/s may be disclosed for; the purpose for which it was collected, to other parties including the landlord, our staff, cleaners, contractors, the police if a problem arises, referees, financial institutions, other Agents, third party operators of tenancy reference databases may also be disclosed to the agent or landlord if deemed necessary.

2. Bookings

You are engaging Rex’s Yarra Valley House for accommodation as a fixed price service and agree for us to subcontract any services as we see fit.

All bookings are subject to approval.

A booking may be cancelled or altered by the owner at any time, in the event of this occurring we will endeavour to find alternative accommodation.

All booking are managed by Mark Gunther First National Real Estate. Mark Gunther First National cannot be held responsible for the action taken by the owner, third party or unforeseen event occurring beyond our control.

It is the responsibility of the guest to ensure that the information on your confirmation form is correct. This includes dates and amounts charged.

2.1.1 How to cancel a booking?

All cancellations must be made in writing.

Full refund for cancellations made at least 30 days prior to check in.

50% refund for cancellations made within 30 days before check in.

No refunds for cancellations made within 7 days of check in.

No refunds for no-show.

We recommend travel insurance to cover all possibilities. 

Refunds will only be direct deposited into your nominated bank account.

3. Payments

To secure your holiday accommodation we require a deposit.

All deposits and final payments are held in an audited trust account with Mark Gunther First National Real Estate.

Total balance is due 14 business days prior to stay, if booking is less than 30 days to check in date total payment is required.

Full rental fee and bond monies are payable by the guest/s in advance and before the keys to the property are released.

You agree to make payments for any services on time and the exact amount specified by Rex’s Yarra Valley House, follow up phone and email communications will be sent to organise payments.

If the balance is not received by the due date we reserve the right to charge your credit card, including merchant fee charges.

Payment of deposit denotes acceptance of Terms & Conditions.

3.1.1 Paying for your booking

All payments are made to Mark Gunther First National Real Estate, payment methods will be sent to you upon confirmation of booking.

3.1.2 Bond

A bond payable upon booking of $850.

You agree to reimburse Rex’s Yarra Valley House for any damages made to the property or land. For example but not limited to flooding, broken windows, chairs and doors.

The bond is to be paid prior to check in and will be refunded to you within 7 days of check out subject to inspection of the property being left in a clean condition with no damage.

3.1.3 Late payments

You agree to pay on time to avoid any late payment interests. You agree to pay the full amount in Australian dollars (AUD) to the account specified by Rex’s Yarra Valley House. Rex’s Yarra Valley House reserves the right to cancel a booking until final payment is made. If a payment delay is anticipated, please contact Rex’s Yarra Valley House immediately for an alternative arrangement.

4. Legal

You agree that the booking requested cannot be transferred to anyone without their or our permission. If for some reason one part of this agreement becomes invalid or unenforceable, the remaining parts of it remain in place. Although the language is simple, the intentions are serious and this agreement is a legal document under exclusive jurisdiction of Australian courts. You accept the Terms and conditions of this agreement on behalf of your organisation, business or self. This agreement constitutes the entire understanding of both parties. You agree and understand this agreement and its terms.

4.1.1 Privacy policy and Terms and conditions

Rex’s Yarra Valley House adheres to best practice with the data we collect and use. Our Privacy policy explains what happens with any personal data that our website captures. You agree and understand our Privacy policy. You agree to not hold Rex’s Yarra Valley House accountable for any breaches in regards to this.

4.1.2 Liability, Indemnification and Litigation

You agree that any use of the property will not be abusive or unethical. Rex’s Yarra Valley House has the right to remove and terminate any booking that deems unethical or abusive. You agree to defend, indemnify, save and hold Rex’s Yarra Valley House harmless from any and all demands. Including liabilities, losses, costs and claims and legal representation fees. This includes liabilities asserted against Rex’s Yarra Valley House subcontractors, clients or employees. You agree that any disputes arising from this agreement have litigation laws heard in Melbourne, Victoria. This agreement governed and construed under the laws of the Australian Government.

5. Updates to the Terms and conditions

Rex’s Yarra Valley House reserve the right to amend the Terms and conditions at any time.
